Lumepoint – Terms and Conditions

Welcome to Lumepoint. These Terms and Conditions govern your access to and use of the Lumepoint website, software, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and Conditions. If you do not agree, you may not access or use the Services.
1. Acceptance of Terms
By accessing and using Lumepoint, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including our Privacy Policy (which is incorporated herein by reference). If you are using the Services on behalf of a business or organisation, you are agreeing to these Terms on that organisation’s behalf and confirming that you have the authority to do so. In that case, “you” and “your” refer to that organisation.
2. Description of Services
Lumepoint is a laser engraving software platform that enables users to upload images, generate point cloud files, and prepare designs for engraving on crystal and other materials. The Services include:
• Image Processing Tools: Upload and convert images into laser-ready engraving files.
• Point Cloud Generation: Automated generation of 3D point cloud data from user-submitted images.
• Design Management: Tools for organising, editing, and exporting engraving-ready files.
• Platform Access: Available via desktop, cloud, and mobile applications.
Output quality is dependent on the quality of images submitted by the user. Lumepoint is not responsible for engraving outcomes arising from low-resolution or unsuitable source images.
3. User Accounts
To access certain features of the Services, you will be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. Lumepoint reserves the right to suspend or terminate your account if any information provided is found to be inaccurate, incomplete, or misleading.
4. User Content
You may upload images and other materials (“User Content”) to the Services. You retain ownership of your User Content. By uploading User Content, you confirm that:
• Data Usage: Lumepoint may process your User Content solely to provide and improve the Services.
• Data Retention: Your data will be retained for 24 months from the date it is provided, or for as long as your account remains active, whichever is longer.
• Ownership and Rights: You have all necessary rights to the content you upload and confirm it does not infringe any third-party intellectual property, privacy, or publicity rights.
5. Lumepoint’s Rights to Data
You acknowledge and agree that Lumepoint collects and processes data, including User Content and usage data, for the following purposes:
• Providing and improving the Services.
• Developing new features and functionality.
• Analysing usage patterns to improve platform performance.
• Generating aggregated and anonymised data for statistical and product development purposes.
• Maintaining your account and providing customer support.
• Complying with legal obligations.
You grant Lumepoint the right to retain access to and use your data for as long as your account is active. Following account termination, your data will be retained for 24 months for the purposes outlined above. We have a legitimate interest in this; however, you may request data deletion at any time by contacting us at privacy@lumepoint.com.
6. Cookies
Lumepoint uses cookies to monitor website usage and manage user sessions. These are primarily session cookies retained for a limited period. Further information can be found in our Cookie Policy.
7. GDPR Compliance and Your Rights
Lumepoint is committed to complying with the General Data Protection Regulation (GDPR). As a user of the Services, you have the following rights regarding your personal data:
• The right to access: You may request a copy of the personal data we hold about you.
• The right to rectification: You may request that we correct inaccurate or incomplete data.
• The right to erasure: You may request that we delete your data, subject to legal or legitimate business retention requirements. Deletion may affect your access to the Services.
• The right to restrict processing: You may request that we limit how we process your data in certain circumstances.
• The right to data portability: You may request your data in a structured, machine-readable format.
• The right to object: You may object to processing for direct marketing or other purposes.
• The right to withdraw consent: Where processing is based on consent, you may withdraw it at any time.

8. Intellectual Property
The Services and their original content, features, and functionality are owned by Lumepoint and are protected by applicable copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LUMEPOINT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. OUTPUT QUALITY IS DEPENDENT ON USER-SUBMITTED CONTENT AND LUMEPOINT ACCEPTS NO LIABILITY FOR ENGRAVING RESULTS ARISING FROM UNSUITABLE SOURCE MATERIAL.
10. Limitation of Liability
IN NO EVENT SHALL LUMEPOINT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF LUMEPOINT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO LUMEPOINT IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Pricing and Payment
Lumepoint is available under two pricing models, depending on the product version you use:
Annual Subscription (Desktop)
The desktop version of Lumepoint is available on an annual subscription basis. Payment is required in advance of access being granted or renewed. The subscription provides unlimited point cloud generations for the duration of the billing period. Pricing is displayed on our website and is subject to change with reasonable notice provided prior to any renewal.
Consumption-Based Credits (Cloud and Mobile)
The cloud and mobile versions of Lumepoint operate on a pay-per-use credit model. Each conversion or point cloud generation consumes credits at the rate displayed at the time of purchase. Credits are purchased in advance and are non-refundable once used. Unused credits do not expire but are non-transferable between accounts. Current credit pricing is displayed on our website and within the application.
All payments are processed securely via Stripe. By making a purchase, you also agree to Stripe’s terms of service. Lumepoint reserves the right to adjust pricing across both models with reasonable prior notice.
12. Free Trial
Lumepoint offers a 3-day free trial for new users. The trial provides access to core platform features. At the end of the trial period, access will be suspended unless a paid plan is purchased. No payment details are required to start a trial. Trial accounts may be subject to usage limitations at Lumepoint’s discretion.
13. Cancellation Rights
You may cancel your annual subscription at any time. You will retain access to the Services until the end of your current annual billing period. No full or partial refunds will be issued upon cancellation. Cancelled accounts will revert to an inactive state unless otherwise requested. If you believe you are entitled to a refund under applicable consumer protection law, please contact us at support@lumepoint.com.
14. Indemnification
You agree to indemnify and hold Lumepoint harmless from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms and Conditions.
15. Termination
Lumepoint may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at support@lumepoint.com. Upon termination, your right to use the Services will immediately cease.
16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cyprus, except where mandatory consumer protection laws in your country of residence require otherwise.
17. Changes to Terms and Conditions
Lumepoint reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of the Services following any update constitutes your acceptance of the revised Terms.
